Xerox Knowingly Sells Certain Defective Versant Digital Presses To ‘Unwitting Consumers,’ New Class Action Claims - Top Class Actions

Xerox Corporation manufactures, markets, and sells certain Versant digital presses that contain defective component parts, a new class action lawsuit alleges.

Plaintiff Neala Communications LLC claims Xerox actively chooses not to fix the problem and instead continues to sell the allegedly defective digital presses to “unwitting consumers.” 

Neala claims further that the affected Versant digital presses use defective toner that is manufactured and distributed by Xerox, which either triggers, causes, or exacerbates the issue. 

“The presses, by virtue of their defects, are susceptible to inconsistencies in the toner products,” the class action lawsuit states. “Those inconsistencies, which have been observed in a substantial percentage of the relevant toner products, trigger the defects in the presses and cause damage to various components thereof, including drums, rollers, and developer housings.”

Neala wants to represent a nationwide Class of persons or entities who purchased a Xerox Versant 80, Xerox Versant 180, Xerox Versant 2100, or Xerox Versant 3100 digital press. 

Neala says it has been leasing two V180 presses from Xerox on a 60-month term since January 2019. The lease includes a maintenance plan and an option to purchase the press for fair market value, according to the class action lawsuit. 

Neala argues Xerox is failing to honor its maintenance plan, which requires the company to keep the digital presses in “good working order,” by providing on-site support, necessary repairs, and replacement parts. 

“[The] defendant has failed to maintain the presses and keep them in ‘good working order’, and the defendant has failed to replace the presses as it is contractually obliged to do,” the class action lawsuit states. 

Neala claims individuals who purchased the affected Versant digital presses did not receive the benefit of their bargain and suffered from overpayment due to print costs, wasted material, and other out-of-pocket expenses. 

Neala claims Xerox is guilty of breach of contract, negligence, and unjust enrichment, and in violation of the Lanham Act and New York General Business Law. 

Plaintiff is demanding a jury trial and requesting injunctive relief along with actual, compensatory, statutory, and punitive damages for itself and all Class Members. 

A separate class action lawsuit was filed against Xerox last year by employees arguing the company inflated recordkeeping fees they were required to pay in order to participate in its pension benefits plan.

I would like to pass the details of a law firm who themselves have this issue with their recently bought versants, perhaps if you get them on board you may get a lift in the right direction?

Xerox signed us up for a lease on a Versant 180 in December of 2020, virtually right off they started slow shipping supplies then it got real bad. Had to lease a Canon and now waiting on a class action lawsuit to put Xerox out of business so we can tear up the unreasonable contract we signed. Can’t get toner now at all, all of last year we had to deal with the drum shortages and toner issues now it’s toner shortages. Sign us up for a class action lawsuit and destroy this unscrupulous company!

I’ve been with Xerox for many years. I’ve had the same issues as everyone else. Defective drums, cant get toner or other supplies, many wasted and spoiled jobs. I don’t know how they are able to get away with not living up to their end of the contract.

We’ve had a V180 for three years. We really liked the machine and the product it put out until a year or so ago when we started seeing the same problems described here. We were also told the issue was drums for a long time and we have had to fight and scrape to get Xerox to send us replacements. They always claim that based on percentages we can’t have used up the current drums yet which is mind boggling because surely they know why we’re asking for new drums. I’ve been committed to Xerox for a lot of years but I’m now talking to Canon about our next replacement as this experience (and the lack of transparency from Xerox) has caused me to lose faith in them.

We have a Versant 180 and it’s been a disaster from day one. Discounting the fact that every word out of the sales manager’s mouth was an outright lie, this machine has had every problem described above and more. It is a poorly designed and poorly constructed machine not up to the demands of even a casual print user much less a commercial print shop. I wouldn’t wish this piece of crap on my worst enemy.

Same problems here. Drums are constantly failing with speck damage on the drum surface. First we were told they were bad drums, then the story change to being bad toner. We ran out of good drums and Xerox couldn’t ship any because they were backordered. We’ve had to spend money on drums and parts to keep our V180 running because Xerox parts have been on backorder. Now we can’t get toner because it’s backordered and we’ve had to order our own toner from a third party, so it’s like we’re paying for toner twice when we print. Still no word from Xerox when Magenta or Black toner will ship. Latest word from one of our techs is that Xerox is redeveloping the toner manufacturing for the Versant, making a smaller particle. If Xerox can’t start shipping reliable toner soon we’ll have to purchase a machine from a different manufacturer and dump Xerox.

We do have had Versant 80 and have fought many problems bad drums and toners – we had to purchase a second Canon machine not because our print volume but because the Xerox is unreliable and further more we now have been in operate 13 days out of 16 days this month as we can not get supplies – no toner – we have had toner on backorder for 3 weeks. We also never received the 3rd party software for color management and have operated nearly 2 years without Graphic arts packages we pay for every month. Xerox has become the worse… If someone knows how we join this Class Action or can help us get out of our contract please contact me! 952-890-7798

Have had a Versant 80 for 4 years – all started well but then 2nd BTR nightmare, managed 34 in 4 years, now toner and drum issues, toner sticking to drum creating coloured blobs and lines after only 10% usage.

Wastage has been horrendous Xerox engineers just blame the paper nearly bankrupted me this machine beware its getting worse

We have a Versant 80 and have been fighting this machine forever. We’ve had all the issues…Drums, Toner, 2nd BTR, Supply chain issues, etc…

Add me! Me Xerox machine has about done us in. We have received absolutely zero help or concern from Xerox. We have had to buy toner outside our contract to keep or machines operating (and tossing plenty away) from the stupid drum dots! This has been a nightmare I have been fighting for over 5 years. We just installed a Heidelberg/Ricoh and it is night and day difference. Xerox must pay!

V180 and V280. Same problems. For about 2 years — drum issues, 2nd BTR issues, supply issues, overcharges for prints that were not sellable, no compensation for paper losses or labor from Xerox. Xerox doesn’t care, they are totally unresponsive to any request for answers or discounts or compensation. Unfortunately, they have an ironclad “in their favor” contract which rewards their bad business behavior. They are now telling me it was a toner issue all along and new toner formula will fix everything. Unfortunately, the new formula evidently is missing something … colors not as rich and solid black looks really weak. And cyan drum blew out less than a week after new toner was installed. And the drum section got hung up and will not open to replace the drum. Yes, that is fixed, alright!

We leased 3 -V180s. I had them all pulled from the production floor and replace with Canons. We were down for months, had to send jobs to other printers say not to print jobs or simply tell our customers we couldn’t do their work. I am now paying leases for another 30 months for three machines that are sitting in storage that I cannot use. Xerox is also dragging their feet cancelling my service contracts for the machines not in use because of their drum issues. Count me in on the suit!!!

Have same problems we versant 3100. Ended up replacing it with another vendor. Although still paying for versant. Xerox denied there was a problem for longest time. Can we join this suit?

Can not get metered contracted supplies for my versant 180 all toner colors are back ordered, no drums. Own a printing company, we have no supply’s, drums fail way before they should, parts fail way before they should. Don’t know if I can provide my customers with printing one day to the next. Has been a nightmare.

I have been fighting with my V80 and V180. I never had the problem with my V80 for 5 years. The drums would run down to 10 and 15% before I needed to replace. Now I cannot get the drums to go past 90% without failing getting the dreadful traveling dot. I have wasted loads of paper and click charges. My Xerox Rep did compensate me some click charges because of my complaining. I Leased a new V180 and purchased the V80 in 2021 having no idea this would happen. It is has been like pulling teeth trying to get replacement drums. Reps would say that your machine is showing your drums are at 90% so we will not send new ones. After weeks of fighting they have gotten better about sending drums. Been a nightmare!

I have a Versant 180 for over 4 years now. The past year has been terrible for the quality of the supplies. Either I can’t get toner and drums or the drums go bad in a very short time. Way too much spoilage in bad printing jobs. The problem does not seem to be getting any better. Very disappointed with Xerox being a customer for over 25 years.

I have had a Versant 80 for 5 years now. We may be lucky to have an ealrlier machine. It runs fine but we recently ordered a Versant 280 which is not on the class action list. Maybe because it is too early yet. We ordered it at the end of October and it is now middle of March. Still not here yet and no one has an idea when it is arriving. now I am greatly concerned.

Please contact me as we have battled with our Two Versant 180s and One Versant 3100. Currently all three are in use, with lots of waste product and frustration.

We have a Versant 80 and 180. This issue nearly destroyed us. Xerox bullied us into paying all our expenses but offered us $74 discount – our losses were in the thousands. Count me in.

Same here. I have two of these machines. Got them in 2020 and it’s a constant battle. Thousands of dollars worth of wasted paper and countless hours of lost productivity and frustration from my employees. Xerox keeps blaming one thing and another with no solution in site.

You are describing exactly the situation we are in with a Versant 180 that we leased in February of 2019.

I’ve struggled with this machine for 3 years. The amount of paper waste is very high, not to mention time.

True story, I lost an employee because I cursed so much at the machine!
